SOFTWARE PIRACY - A CANCEROUS GROWTH
 
  1. Illegally copied computer Software amounts to 'Software Piracy' and is an infringement of “Intellectual Property Rights” (IPR).
  2. Software Piracy is rampant in India hitting Indian developers of their popular software program 'SHREE LIPI.' Software Piracy at the micro level has grown like a deadly cancer, hampering the nation's fastest growing industry.
  3. Anyone who violates any of the exclusive rights of the Copyright owner by reproduction, adaptation, distribution etc. is an infringer and is liable for criminal penalties under Section 63 (b) of Copyright Act 1957 as amended in 1994 which prescribes arrest and minimum 7 days Rigorous Imprisonment extendable to 3 Years AND a minimum fine of Rs. 50,000/- extendable to Rs. 2 Lakhs..
  4. Losses in I.T. industry are significant due to software piracy resulting in retarding industry growth in R.& D., employee motivation due to loss of revenue to the companies and loss of job opportunities. The overnment also suffers on account of loss of Tax revenues on software sales affecting G.D.P. growth as well. Rs. 2190/- Crores were lost by the exchequer in 2004-2005 in form of taxes due to a loss in business of Rs. 54,750 Crores as a result of 74% piracy in a domestic business of Rs. 75,000/ Crores approximately.
